Terms of Service

1. Agreement to Terms

By downloading, installing, or using the OpenHousePad mobile application ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the application.

2. License to Use

OpenHousePad is provided to licensed real estate professionals, agents, brokerages, and hosts as a free software utility under a non-exclusive, non-transferable, revocable license on compatible Apple iOS/iPadOS devices that you own or control, in accordance with Apple's App Store Terms of Service.

3. Professional Conduct & Communication Compliance

You are solely responsible for ensuring that your collection, storage, and subsequent communication with leads collected via OpenHousePad complies with all applicable local, state, and federal laws and industry regulations (including, but not limited to, the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, National Do-Not-Call registries, and state real estate licensing requirements).

4. Data Custody & Security

OpenHousePad operates strictly as a local-first software application. Data entered into the application remains stored within your device's local application sandbox. You are solely responsible for setting and maintaining a secure PIN code, maintaining physical possession of your iPad during kiosk operations, and backing up exported CSV and PDF files to your preferred secure cloud or CRM systems.

5. Disclaimer of Warranties

The application is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. The developer does not warrant that the operation of the application will be uninterrupted or error-free.

6. Limitation of Liability

To the fullest extent permitted by applicable law, the developer shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use the application, including loss of lead records or hardware malfunctions.
